[2] The regulation, as then promulgated, provided in relevant part:
1845.3(a) The normal business hours of the driver shall be 8:00 a.m. to 4:00 p.m., Monday through Friday except the following holidays: Martin Luther King Day; Veterans Day; Thanksgiving Day; and Christmas Day.
1845.3(b)(1) In the case of interstate towing the normal business hours of the driver shall be 8:00 a.m. to 4:00 p.m., Monday through Friday except the following holidays: Martin Luther King Day; Veterans Day; Thanksgiving Day; and Christmas Day. The normal business hours shall be calculated by driving time from the route origin to the route destination. The driver shall drive in the front seat of the vehicle towing the load, unless other conditions apply.
1845.3(c) (1) The driver shall comply with the driver's license requirements of the state in which the normal business hours are established for the route; and
1845.3(c)(2) A driver shall not be required to commute from the route origin to the route destination during the normal business hours of the driver or any part of the route.
1845.3(d) A driver shall not perform work or participate in work of any kind while driving or between the hours of 7:00 a.m. and 7:00 p.m. during the normal business hours of the driver.
1845.3(e) In the case of an interstate towing business, the driver shall be responsible for the interstate towing of a load or loads that are involved in an accident.
(f) If any part of the driver's normal business hours is not in the Eastern Time Zone, the driver shall report to the shift leader at the normal business hours at the point of dispatch from the route origin.
1845.3(g) A driver must notify the driver's employer at the earliest possible opportunity of the occurrence of any accident or of any violation of these regulations.
(h) Drivers are responsible for the accurate completion of the driver's log.
1845.3(i) A driver shall not drive unless the vehicle is in good operating condition.
